These Terms of Service (“Terms”) govern your access to and use of the Home of Cards mobile game, website, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least the minimum age required by the laws of your country to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

You are responsible for complying with local laws if and to the extent they apply to your use of the Service.

3. The Service

Home of Cards is a digital card game and entertainment service. The Service may include:

– gameplay features;
– player accounts and profiles;
– virtual currency, consumables, boosters, cosmetics, or other virtual items;
– in-game events, rewards, leaderboards, and promotions;
– customer support features;
– links or integrations with third-party platforms or services.

We may change, update, suspend, or discontinue any part of the Service at any time, including game modes, rewards, availability, or technical features.

4. Accounts

You may need an account to access some parts of the Service. You agree to provide accurate information and to keep that information up to date.

You are responsible for:

– maintaining the confidentiality of your login credentials;
– all activity that occurs through your account;
– notifying us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts that violate these Terms, applicable law, platform rules, or the fair-play standards described below.

5. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service for your own non-commercial entertainment purposes.

This license does not transfer any ownership rights in the Service or its content.

6. Fair Play and Acceptable Use

You agree not to:

– cheat, exploit bugs, use bots, scripts, automation, or unauthorized third-party software;
– reverse engineer, decompile, disassemble, or attempt to extract source code except where prohibited by law from being restricted;
– interfere with the Service, servers, security systems, or other players’ use of the Service;
– buy, sell, share, or transfer accounts except where we expressly allow it;
– use the Service for fraud, harassment, abuse, spam, or unlawful conduct;
– manipulate events, matchmaking, rankings, leaderboards, reviews, or referral systems;
– upload or transmit viruses, malware, or harmful code;
– infringe intellectual property or other rights of any person or entity.

If you discover a bug or exploit, you agree not to abuse it and to report it to us.

7. Virtual Items and In-Game Currency

The Service may include virtual currency, points, tokens, boosters, cosmetic items, rewards, or other in-game digital items (“Virtual Items”).

Virtual Items:

– are licensed, not sold;
– have no cash value unless required by law;
– are not redeemable for money or real-world value from us;
– cannot be transferred, traded, or sold unless we explicitly permit it in writing.

We may manage, regulate, modify, or remove Virtual Items, including their availability, pricing, or usefulness, at any time as part of operating the game.

To the maximum extent permitted by law, we are not liable for loss of Virtual Items resulting from account suspension, technical changes, balancing decisions, or termination of the Service.

8. Purchases and Billing

Some parts of the Service may be paid, including in-app purchases and premium content. Prices and available purchase options may change at any time.

If you make a purchase through the Apple App Store, Google Play, or another third-party platform, that platform may process payment, taxes, billing, and refunds under its own terms and policies. We do not control third-party payment processing.

You agree that:

– all purchase information you provide must be accurate and authorized;
– you are responsible for any applicable taxes, fees, or platform charges;
– we may limit, cancel, or refuse transactions where fraud, abuse, or technical issues are suspected.

9. Refunds

Except where required by applicable law, purchases for digital content, in-game currency, and Virtual Items are final and non-refundable once delivered or made available to your account.

If your purchase was made through a third-party platform such as Apple App Store or Google Play, refund requests may need to be submitted through that platform and will be handled under its policies.

Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

10. Events, Promotions, and Rewards

We may offer limited-time events, seasonal content, promotions, sweepstakes, contests, or reward programs. Additional rules may apply to those activities, and those rules will form part of these Terms for that activity.

We may cancel, modify, or end any event or promotion at any time where reasonably necessary, including for legal, technical, fraud-prevention, or operational reasons.

11. User Content and Feedback

If the Service allows you to post a username, profile image, chat content, support messages, or other content (“User Content”), you retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, display, and use that User Content as necessary to operate, improve, and promote the Service.

You represent that you have the rights needed to provide any User Content you submit.

Any suggestions, ideas, or feedback you provide regarding the Service may be used by us without restriction or compensation to you.

12. Intellectual Property

The Service, including its software, gameplay systems, visual design, audio, text, branding, logos, characters, and other content, is owned by us or our licensors and is protected by intellectual property laws.

Except for the limited license granted in these Terms, no rights are granted to you.

13. Third-Party Services

The Service may link to or integrate with third-party services, including app stores, analytics providers, ad networks, social login providers, customer support tools, or payment processors.

We are not responsible for third-party services, their content, availability, or policies. Your use of third-party services may be subject to separate terms and privacy policies.

14. Service Availability

We work to keep the Service available and secure, but we do not guarantee that the Service will always be available, uninterrupted, error-free, or free from delay, loss, corruption, or security incidents.

Game balance, difficulty, reward systems, progression systems, and feature availability may change over time.

15. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service, with or without notice, if:

– you violate these Terms;
– we believe your use creates risk for the Service, other users, or us;
– we suspect cheating, fraud, unauthorized payments, chargebacks, or abuse;
– we are required to do so for legal or operational reasons.

You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, dispute-related provisions, and any payment obligations accrued before termination.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

– the Service will meet your expectations;
– the Service will be uninterrupted or error-free;
– defects will always be corrected;
– game outcomes, rewards, or progression will remain unchanged.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, Home of Cards and its affiliates, directors, employees, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or virtual items arising out of or related to the Service.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve (12) months before the event giving rise to the claim, or EUR 50 if you have not made any payments, whichever is greater.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Home of Cards and its affiliates, officers, employees, and partners from claims, damages, losses, and expenses arising out of:

– your misuse of the Service;
– your violation of these Terms;
– your violation of any law or the rights of a third party.

19. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect personal data.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Last updated” date. Where required by law, we will provide additional notice.

Your continued use of the Service after updated Terms take effect means you accept the revised Terms.

21. Governing Law

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict of law principles, except where mandatory consumer protection laws require otherwise.

Any dispute that cannot be resolved informally will be submitted to the competent courts in Serbia, unless applicable law provides otherwise.
